What is an Occupation Certificate?

The Environmental Planning and Assessment Regulation 2000 requires an Occupation Certificate to be issued to an owner or occupier prior to legally occupying or using a new building or new part of an existing building. An Occupation Certificate can only be issued by the Principal Certifier (PC) appointed for the building work. The occupation or use of a new building a or new part of an existing building prior to the issue of an Occupation Certificate may attract penalties including the possible issue of a Penalty Infringement Notice.
