Byles Creek Planning Proposal

Council has resolved to progress the Byles Creek Planning Proposal, which seeks to amend the Hornsby Local Environmental Plan 2013 (Hornsby LEP) in line with the endorsed Byles Creek Planning Study (the Planning Study).

The Planning Proposal affects the Byles Creek Study Area (the Study Area), which is in the suburbs of Pennant Hills and Beecroft. The study area is shown in red on the map below.

When finalised, the planning proposal would:

  • Rezone land within the Study Area currently zoned R2 Low Density Residential to C4 Environmental Living.
  • Increase the minimum subdivision lot size for land proposed to be zoned C4 Environmental Living from 600m2 to 40ha.
  • Amend the objectives of Clause 4.1 ‘Minimum subdivision lot size’ to protect and enhance existing bushland and significant native vegetation.
  • Map the riparian corridor within the Study Area and insert a new additional local provision that must be considered when developing on riparian land.

The proposal was considered at the 14 December 2022 Council meeting, with the report to Council available here. At the meeting, Council resolved to progress the proposal for Gateway determination.

A Gateway determination was issued by the Department of Planning and Environment on 18 May 2023 with confirmation on 25 July 2023 that the Planning Proposal may proceed to public exhibition. Progress of the proposal can be monitored on the NSW Government Planning Portal website.

The public exhibition was held between 18 August 2023 and 15 September 2023, in accordance with Council’s community consultation plan.

At its general meeting on 8 November 2023, Council considered a report on submissions and resolved to endorse the Planning Proposal and associated Hornsby Development Control Plan (Hornsby DCP) amendments for finalisation. The Council report and meeting minutes are available here.

Council will be working with the Department of Planning and Environment to finalise the proposed Hornsby LEP amendments. A notice will be placed on the NSW Legislation website to advise when the Plan has been made and comes into effect.

The associated Hornsby DCP amendments will also be finalised and a notice will be placed on Council’s website to advise when they come into effect.
