Planning Proposal for 7 City View Road, Pennant Hills
The owner-initiated Planning Proposal for 7 City View Road, Pennant Hills seeks to amend the Hornsby Local Environmental Plan 2013 (HLEP) to facilitate a mixed use development comprising residential, commercial and community facilities as part of a future development application. This is proposed to be achieved by introducing a new Local Provision that would permit residential flat buildings, seniors housing and an increased FSR for the site, if the development would result in the delivery of a minimum 0.5:1 floor space ratio for commercial uses.
The Planning Proposal is accompanied by a draft planning agreement, which is a proposed legal agreement between the Council and the landowner. If finalised, it would require a developer to provide the following community benefits with a future development:
- Four apartments, dedicated to Council, for the purposes of affordable housing
- Monetary contribution of $450,000 for Pennant Hills Town Centre improvements
- A new access through the site from City View Road to Boundary Road.
The Planning Proposal and draft planning agreement were considered at the 9 August 2023 Council meeting, with the report to Council available here. At that meeting, Council decided to progress the proposal for Gateway determination.
The Department of Planning and Environment (DPE) issued a positive Gateway determination, allowing public exhibition of the Planning Proposal and draft planning agreement to proceed.
Public exhibition of the proposal was held between 15 September and 20 October 2023, in accordance with Council’s community consultation plan.
Council considered a report on submissions at its 13 December 2023 meeting and resolved to endorse the Planning Proposal and associated planning agreement. The Council report and meeting minutes are available here.
Council will be working with the NSW Government to finalise the proposed Hornsby LEP amendments. A notice will be placed on the NSW Legislation website to advise when they come into effect.
