Legal Advice on Hornsby Quarry
Advice 1: The legal advice has been tendered as evidence as part of action by Council in the Supreme Court of NSW and is therefore now a public document. Accordingly, the previous redacted version of the legal advice has been replaced with the entire advice.
Legal advice from Mr Tim Roberston, SC, in response to questions from the public concerning the process undertaken for the acquisition of Hornsby Quarry. The advice also addresses the issue of whether there is an avenue of appeal from the Valuer General's determination in view of the findings of the Hornsby Quarry Land Capability Study and the Economic Feasibility Review.
Advice 2: Legal advice from Mr Tim Roberston, SC, concerning whether Council enjoys any contractual rights arising from an offer made in 1966 by Farley and Lewers Ltd, the then quarry owner, to transfer the quarry and surrounding land to Council upon the cessation of quarry activities.
