Draft Hornsby LEP


Under recent NSW Government reforms, all NSW councils are required to prepare a new Local Environment Plan in accordance with the State Government’s standard Local Environmental Plan template (Standard Instrument).

Council has drafted its new Hornsby Local Environmental Plan (HLEP). The preparation of the HLEP has principally been a process of transferring Council’s existing Local Environmental Plan, the Hornsby Shire Local Environment Plan 1994 (HSLEP), into the new Local Environmental Plan format. When made, the HLEP will control development and guide planning decisions made by Council. It also aims to ensure that new development is sustainable and compatible with the character of the Shire.

A report presenting the draft Plan and how key translation issues have been resolved was presented to Council at its December 2010 meeting. At the meeting, the draft Plan was endorsed by Council for consultation with public authorities. Accordingly, consultation was undertaken and amendments made (where necessary). Amendments to the draft HLEP were also made in response to the release of the latest version of the Standard Instrument and other new planning legislation.

A report reviewing the submissions received in response to the consultation was considered by Council at its June 2011 meeting. Council endorsed a revised draft HLEP for public exhibition and resolved that a submission be made to the Department of Planning and Infrastructure (DP&I) requesting certification to enable the draft Plan to be placed on public exhibition. Accordingly, a submission was made requesting certification of the draft Plan.

In October 2011, Council received conditional certification from the DP&I. A report seeking endorsement of a revised draft HLEP for public exhibition that addresses the conditions of certification will be considered by Council at its March 2012 meeting. The report (which can be viewed under progress updates) recommends that Council exhibit the revised draft Plan for a minimum period of sixty days once the Plan has been recertified by the DP&I for exhibition.

Before receiving certification to exhibit, the draft HLEP has been made available to the public for viewing (see below) to inform the community about the plan preparation process to date. While the draft HLEP has been made available for viewing, submissions on the draft Plan should only be made during the formal exhibition period as the DP&I may require further minor changes before the draft Plan is certified for public exhibition.

It is anticipated that Council’s draft HLEP will be exhibited for community comment in mid 2012 and submitted to the DP&I for finalisation in late 2012.

The draft Plan on display is not:

  • the subject of a Section 65 Certificate authorising exhibition of the draft Plan and should not be relied upon as being certain or imminent;
  • on public exhibition pursuant to Section 66(1) of the Environmental Planning and Assessment Act, 1979 (as of 30 June 2009); and
  • a matter for consideration under Section 79C(1)(ii) of the Environmental Planning and Assessment Act, 1979 and should not be relied upon to inform planning decisions.
